* 1 The seller obtains an ownership title certificate

The Seller prior to signing the sale contract applies with the Immovable Properties Registration Office to obtain the fresh Property Record where are reflected any liens, mortgages, leases or other encumbrances registered over the property. The Property Records are accompanied by the Property Map.

The Immovable Properties Registration Office of Tirana issues the Ownership Certificates for the properties registered under the new electronic registry. For the properties that are not registered in the electronic register the Immovable Properties Registration Office issues an Ownership Attestation.
Ownership Certificate is issued only once, while the Ownership Attestation is issued upon request of the owner or its representative.

The buyer upon authorization of the seller, can file for verifications purposes, the property status and for photocopies (each page 50 ALL) of the Ownership Certificate/Attestation, updated Property Records and Property Map. The buyer verifies the property Certificate and relevant map at the Real Estate Registry.

3 Comparison of property map with the real situation and position of the land

While this procedure is not mandatory by law, it is done in practice by the buyer to avoid any dispute with third parties caused by borders misfit and/or land surface.
Verification is performed by a private authorized expert (topographer). The cost can be agreed upon by the buyer and seller upon which party will cover this expense. The law does not regulate the topographer fees and it is estimated between 15000 ALL - 20 000 ALL.

4 Notarization of the sale and purchase contract by a notary public

The notary fees are defined by the Order of the Ministry of Justice dated 23.01.2001.
In order to execute the sale-purchase contract the seller submits to the notary public:
i) Ownership Certificate or the Ownership Attestation;
ii) the updated Property Records, issued not later than 72 hrs before the contract signature;
iii) Property Map

5 Payment of taxes (local and income tax) at a second-tier bank

According to the law no. 9632, dated 30.10.2006 amended, “On local taxes” in case of transfer of ownership over a commercial building only for Tirana and Durresi Municipality, a tax rate of 2000 ALL per square meter will be applied in favor of the respective municipality.

This tax rate is applicable only to commercial buildings as the law provides that in cases of residential building or other buildings not for commercial purposes, a different tax rate is applicable.

In addition under the law no. 8438, dated 28.12.1998 "On the income tax", as amended, the seller is subject to the income tax. The income tax of 10% applies on the overall corporate income of the company and is payable at the end of the financial year. In the transactions of immovable properties the VAT tax is not applied. Both, fee and tax are payable at any second-tier bank of the territory of Albania.

6 Apply for registration at the Real Estate Registry Office

The buyer files for registration of the executed contract at the Tirana Immovable Properties Registration Office, within 30 days from the date of the contract signature.
The buyer files the original copy of the contract signed by both parties, accompanied by the
i) Original copy of the Ownership Certificate or the Ownership Attestation;
ii) the updated Property Records issued no later than 72 hours before the contract is signed;
iii) Property Map and
iv) the receipt of the payment of the fee for transferring the ownership title.
